All trades and actions on ThunderLaunch.fun are final. There are no refunds, chargebacks, or reversals. Smart contracts may fail or be exploited; you accept full responsibility for your transactions.

You explicitly waive your right to request, dispute, or seek refunds for any fees paid under any circumstances, including but not limited to: transaction errors, market volatility, failed transactions, personal regret, or any other reason whatsoever.
ThunderLaunch is not responsible or liable for any losses, damages, or adverse consequences resulting from fee deductions or payment obligations. You assume full responsibility for understanding and accepting all fees before completing any transaction.

TO THE FULLEST EXTENT PERMITTED BY LAW, THUNDERLAUNCH.FUN, ITS PARENT COMPANY, SUBSIDIARIES, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUCCESSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THUNDERLAUNCH.FUN, EVEN IF THUNDERLAUNCH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THUNDERLAUNCH.FUN'S TOTAL LIABILITY FOR ALL CLAIMS, LOSSES, OR DAMAGES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF FEES YOU PAID TO THUNDERLAUNCH IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) $100 USD. THIS LIMITATION APPLIES REGARDLESS OF THE CAUSE OF ACTION, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
YOU HEREBY AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THUNDERLAUNCH.FUN, ITS PARENT COMPANY, SUBSIDIARIES, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUCCESSORS FROM AND AGAINST ANY AND ALL CLAIMS, ACTIONS, SUITS, PROCEEDINGS, LIABILITIES, LOSSES, DAMAGES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR RELATING TO:

THIS WAIVER IS A MATERIAL TERM OF THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THIS WAIVER, YOU MUST NOT USE THUNDERLAUNCH.FUN.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR IN CONNECTION WITH THUNDERLAUNCH.FUN, THIS AGREEMENT, OR YOUR USE OF THE PLATFORM (COLLECTIVELY, "DISPUTES") SHALL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, NOT BY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
The arbitration shall be conducted in English before a single neutral arbitrator and shall be administered by the American Arbitration Association (AAA) or similar arbitration organization. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU UNDERSTAND AND AGREE THAT BY AGREEING TO ARBITRATION, YOU AND THUNDERLAUNCH ARE WAIVING YOUR RIGHTS TO A JURY TRIAL AND THE RIGHT TO PURSUE REMEDIES IN COURT BEFORE A JUDGE OR JURY.
THUNDERLAUNCH.FUN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
THUNDERLAUNCH MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING:
YOU ACKNOWLEDGE THAT CRYPTOCURRENCY AND BLOCKCHAIN TECHNOLOGIES ARE EXPERIMENTAL, VOLATILE, AND SUBJECT TO SIGNIFICANT RISKS, INCLUDING BUT NOT LIMITED TO:
YOU ACCEPT FULL RESPONSIBILITY FOR ANY LOSSES, DAMAGES, OR CONSEQUENCES RESULTING FROM YOUR USE OF THUNDERLAUNCH.FUN OR CRYPTOCURRENCY TRANSACTIONS.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under this agreement shall be exclusively resolved through binding arbitration as provided herein, and you waive your right to bring such actions in any court of law.
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.

Nothing on ThunderLaunch.fun constitutes legal, financial, investment, tax, or professional advice. ThunderLaunch does not provide recommendations regarding the purchase, sale, or holding of any tokens. You acknowledge that you are making independent decisions and that you should consult qualified legal, financial, and tax professionals before using the platform.
ThunderLaunch provides token creators with the ability to broadcast live video streams ("Streams") directly on the platform. By using the streaming feature, you agree to the following additional terms.
Creator Responsibilities
You are solely responsible for all content you broadcast. You represent and warrant that you own or have all necessary rights to stream your content and that doing so does not violate any third-party rights, including intellectual property, privacy, or publicity rights.

Financial Content Disclaimer
All live stream content is user-generated and does not constitute financial, investment, or trading advice from ThunderLaunch. ThunderLaunch does not endorse, verify, or take responsibility for any claims, statements, or predictions made by creators during streams. Viewers are solely responsible for their own investment decisions.
ThunderLaunch's Rights
ThunderLaunch reserves the right to terminate any live stream at any time, without notice, that we determine in our sole discretion violates these Terms or is otherwise harmful to users, third parties, or the platform. Repeated violations may result in permanent restriction of your streaming privileges or account termination.
By streaming on ThunderLaunch, you grant ThunderLaunch a non-exclusive, royalty-free, worldwide licence to store, display, and make available your stream recordings to other users of the platform for a period of up to 90 days after broadcast, solely for the purposes of operating the platform.
DMCA / Copyright Takedown
ThunderLaunch respects intellectual property rights. If you believe a live stream or recorded clip infringes your copyright, please send a written notice to support@thunderlaunch.fun with:
ThunderLaunch will respond to valid DMCA notices by removing or disabling access to the infringing content and notifying the creator. Repeat infringers will have their streaming access permanently revoked.
Stream Recording and Retention
Streams are automatically recorded and stored as 30-minute clips. ThunderLaunch retains up to 10 past streams per token. Older streams are automatically deleted. You may request early deletion of your stream recordings by contacting support@thunderlaunch.fun.
Third-Party Video Processing
Live streaming is powered by Cloudflare Stream or Livepeer, third-party video infrastructure providers. Your video data is processed and stored by these providers subject to their respective privacy policies and terms of service. By using the streaming feature, you consent to your video content being transmitted through and stored by these third-party services.
These Terms of Service, along with our Privacy Policy and any other policies posted on ThunderLaunch.fun, constitute the entire agreement between you and ThunderLaunch regarding your use of the platform and supersede all prior negotiations, representations, and agreements, whether written or oral.
