Ownership of Intellectual Property

ThunderLaunch.fun, including but not limited to its name, logo, design, layout, functionality, software, code, algorithms, databases, content, graphics, images, videos, text, and all other materials (collectively, "ThunderLaunch IP"), are the exclusive intellectual property of ThunderLaunch, Inc., its parent company, subsidiaries, and/or their respective licensors.

All ThunderLaunch IP is protected by copyright law, trademark law, trade secret law, patent law, and all other applicable intellectual property laws and international treaties. ThunderLaunch retains all rights, title, and interest in and to ThunderLaunch IP not expressly granted herein.

The compilation of all content on ThunderLaunch.fun (including the selection, coordination, and arrangement of content) is the exclusive property of ThunderLaunch, Inc. and is protected as a collective work and/or compilation under U.S. and international copyright laws.

No content from ThunderLaunch.fun may be copied, reproduced, modified, republished, uploaded, posted, transmitted, performed, or distributed in any form or by any means, including but not limited to photocopying, recording, or other electronic or mechanical methods, without the prior written permission of ThunderLaunch, Inc., except as permitted by fair use or other applicable law.

Trademark Rights

ThunderLaunch®, the ThunderLaunch logo, and all other ThunderLaunch brand names, marks, logos, and symbols are the registered and unregistered trademarks of ThunderLaunch, Inc. and are protected by trademark laws in the United States and internationally.

You may not use, copy, reproduce, republish, upload, post, transmit, or distribute the ThunderLaunch trademarks or any confusingly similar marks without the prior written consent of ThunderLaunch, Inc. Unauthorized use of ThunderLaunch trademarks may constitute trademark infringement and unfair competition.

All other trademarks, service marks, logos, and brand names displayed on ThunderLaunch.fun are the property of their respective owners. ThunderLaunch disclaims any affiliation, endorsement, or sponsorship relationship with third-party trademarks unless explicitly stated.

Software and Code

All software, code, algorithms, data structures, databases, systems architecture, and technical innovations used in ThunderLaunch.fun are proprietary and confidential trade secrets of ThunderLaunch, Inc.

You may not:

• Reverse engineer, decompile, disassemble, or attempt to discover the source code or trade secrets
• Modify, adapt, translate, or create derivative works based on the software or code
• Remove or obscure any copyright, trademark, or proprietary notices
• Copy, download, or store the software or any portion thereof without authorization
• Use the software for any commercial purpose outside your authorized use of the platform

Unauthorized access to or copying of ThunderLaunch software and code may violate the Computer Fraud and Abuse Act (CFAA) and other applicable laws.

User-Generated Content

Any content, data, comments, feedback, or information you submit, upload, or transmit through ThunderLaunch.fun ("User Content") remains your property. However, by uploading or submitting User Content, you grant ThunderLaunch, Inc. a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to:

• Use, reproduce, modify, distribute, and display User Content in connection with ThunderLaunch.fun
• Sublicense User Content to third parties for platform operation and improvement
• Use User Content for analytics, research, and product development

You represent and warrant that you own or have the necessary rights to grant this license for all User Content you submit. You agree not to submit any content that infringes upon the intellectual property rights of third parties.

Patent Protection

ThunderLaunch, Inc. may own or have the right to use patents, patent applications, and patent-pending technologies related to its services, methods, systems, and innovations. These patent rights are protected under U.S. and international patent law.

You may not make, use, sell, offer to sell, or import any product or service that infringes upon ThunderLaunch's patent rights. Any unauthorized use may result in legal action seeking damages, injunctive relief, and other remedies as permitted by law.

Trade Secrets and Confidential Information

ThunderLaunch possesses valuable trade secrets and confidential information, including but not limited to business strategies, user data, technical specifications, algorithms, market analyses, and operational procedures.

You acknowledge that any information disclosed to you by ThunderLaunch is proprietary and confidential. You agree to maintain the confidentiality of all such information and not to disclose it to third parties without ThunderLaunch's prior written consent.

Unauthorized disclosure or use of ThunderLaunch trade secrets may result in civil and criminal liability under applicable trade secret laws, including the Economic Espionage Act.

Domain Names and Web Properties

ThunderLaunch.fun and all related domain names, subdomains, URLs, and web properties are owned exclusively by ThunderLaunch, Inc. You may not register, use, or attempt to register any domain name, social media handle, or web property that is identical to or confusingly similar to ThunderLaunch's properties.

Any attempt to do so may constitute cybersquatting or unfair competition and may result in legal action under the Anticybersquatting Consumer Protection Act (ACPA) and other applicable laws.

Third-Party Intellectual Property

ThunderLaunch.fun may include references to, links to, or use of third-party intellectual property, including trademarks, logos, and content of blockchain networks (such as Solana), token creators, and other entities.

Such use is for informational and functional purposes only and does not constitute an endorsement by or affiliation with those third parties. All such third-party intellectual property is owned by their respective owners and is protected by applicable intellectual property laws.

ThunderLaunch disclaims responsibility for third-party content and intellectual property rights. Users are responsible for ensuring their use of third-party intellectual property complies with applicable laws.

Infringement Reporting and DMCA

If you believe that any content on ThunderLaunch.fun infringes upon your copyright or other intellectual property rights, you may submit a notification in accordance with the Digital Millennium Copyright Act (DMCA) and applicable law.

To report alleged infringement, please provide:

• Your name, address, and contact information
• A description of the copyrighted work or intellectual property you claim has been infringed
• The specific location of the alleged infringement on ThunderLaunch.fun
• A statement that you have a good faith belief the use is not authorized
• Your signature (electronic signature acceptable) and declaration under penalty of perjury

Submit DMCA notices to: legal@thunderlaunch.fun. False or frivolous DMCA claims may result in liability for damages, including attorney fees, under 17 U.S.C. § 512(f).

Remedies for Infringement

ThunderLaunch, Inc. reserves all rights and remedies available at law and in equity for any infringement of its intellectual property rights, including but not limited to:

• Temporary restraining orders and preliminary injunctive relief
• Compensatory damages and lost profits
• Statutory damages up to $150,000 per willful infringement of copyright
• Treble damages and attorney fees for willful trademark infringement
• Exemplary damages for trade secret misappropriation
• Criminal prosecution under applicable laws
• Immediate removal of infringing content and termination of user access

License Grant and Limitations

ThunderLaunch grants you a limited, non-exclusive, non-transferable license to access and use ThunderLaunch.fun solely for lawful purposes and in accordance with these terms. This license does not include:

• The right to resell or redistribute access to the platform
• The right to modify or create derivative works
• The right to remove or alter copyright or trademark notices
• The right to use any content for commercial purposes outside your authorized use
• The right to grant sublicenses or assign your rights to third parties

ThunderLaunch may terminate this license immediately and without notice if you violate these terms.

Assignment and Transfer

These intellectual property rights are personal to you and may not be assigned, transferred, sublicensed, or shared with any third party without ThunderLaunch's prior written consent. Any attempted assignment or transfer in violation of this provision is void.

Survival

All intellectual property rights and protections granted and reserved herein shall survive termination of your use of ThunderLaunch.fun and shall remain in effect indefinitely.

Severability

If any provision of this Copyright and Intellectual Property Rights notice is found to be unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
